Two Injured When Jet Ski Explodes On Orange County Lake
Re: Two Injured When Jet Ski Explodes On Orange County Lake
People sometimes raise the issue about the terms “Jet Ski” vs. “Personal Watercraft.” I don’t dwell on it much, but here’s an interesting story of how this wording became an issue in a PWC-related injury lawsuit.
The matter arose on a lake in Utah. The owner of a Honda F-12 AquaTrax got into an accident. His passenger sued him for personal injuries. When the owner of the AquaTrax turned to his insurance carrier, he was confronted by wording in the policy that excluded coverage for bodily injury resulting from, among other things, “jet skis and jet sleds… ”
The matter was litigated and the lower court sided with the insurance carrier in denying coverage. But on appeal, the higher court took the side of the owner of the AquaTrax. The court expressed concern over the fact that someone could interpret the jet-ski exclusion in the policy to only mean personal watercraft manufactured by Kawasaki. It’s an interesting case because it illustrates that people have gotten used to using different terms when talking about PWCs.
If anyone wants to look further into the court's decision, the case is Fire Insurance Exchange v. Oltmanns et al, Utah Court of Appeals, Case No. 20100462-CA, 2012
Goes way back to when sitdowns first came on the scene and then all of a sudden, anyone could ride a PWC. Shortly thereafter, the bad press began and the industry took a huge down turn.
I always thought it was the stand-up hooligans that gave riders a bad name.
