Poor Stewards of Our Trust

This is not a victory, it is a sham(e). Will Surfrider address the nuclear dump zones in our Sanctuary waters? A convenient truth often ignored, instead Surfrider agrees that a PWC poses a greater threat than nuclear waste? What is the consensus and backroom deal on this one folks? This is something that should be demanded from your organization and its board of directors in good faith of water quality and safety. The founding fathers of Surfrider would never stand for this kind of organizational behavior. What happened to Surfrider?

Surfrider has been duped into NOAA 'personalized' attack against a specific recreational activity that has absolutely nothing to do with management of sanctuary resources! PWC designs are well above strict federal environmental regulations, and NOAA and Surfrider are both aware of this. Surfrider didn't bother to look at both sides of the issue without prejudice and bias.

There was never a loophole as stated. When biased statements like this are published and adopted from language given by NOAA, groups and citizens are condemned and judged and the weakness of American's not following through on their own volition for truth and accountability. Socialist countries behave in this manner, this is un American. We end up less than informed, a complete injustice to honor and integrity, and our children lose privileges and rights that will probably never be given back. Less government involvement in our lives leads to a better quality of life! Has the Surfrider membership learned nothing about bureaucracy?

Citizen's taxes that would be better spent on making people's lives better, helping our infrastructure, and enhancing our enjoyment and stewardship of our Pacific Ocean and Mother Earth. Education, safety and enforcement policies already existed, we do not need another layer of government managing our lives for us!

Too bad Surfrider didn't study current boating laws and regulations and support our taxpayers in good stewardship and honor in endorsing the boating officers of California who do care about public safety and recreation, regardless of the activity chosen. Laws existed that addressed the concerns of recreational behavior, NOAA never engaged in partnership with California boating organizations, they partnered instead with environmental groups who have no stakeholding in recreational boating.

Take an honest look at surfing and it's impact. I follow a motion for surfing wax, neoprene, surfboard construction, footpaths and trespassing on private property, trash/litter, parking zones, traffic, aggressive abuse of surfers in the lineup, urination, and basically the negative aspects of human impact created by the surfing community to be addressed and evaluated in these same zones. Let's see who really creates more negative impact and accountability. Sounds uncomfortable doesn't it, but it could be a surfers worst nightmare, would Surfrider then support surfers or NOAA? Don't think it can't happen to you.

It would be nice if Surfrider and NOAA would finally provide/'produce their scientific data that has never been presented to the 'stakeholders'. Those who participated in the 'stakeholder' process are all in agreement it was not a democratic and open process that enabled recreational activities to benefit, but to lose. All data given in good faith was catalogued and used against the stakeholders not just boaters, but all stakeholders.

It would also be nice to see the financial report on how much this process from inception to date and into the future management of this review and enforcement will cost taxpayers? Where are those real numbers? How many millions of dollars have been spent from the beginning and in perpetuity to regulate a recreational boating activity, rather than focus on real world environmental concerns, instead of operator behavior of a vessel. And how many PWC's would this include versus surfers?

Any Surfrider member with intelligence could simply look at the 10 ten threats to the Sanctuary resources and sensibility would say a Personal Watercraft definitely does not fit the category of a top 'threat'. Isn't Surfrider supposed to be concerned about the near shore water quality for surfers? What would that exact threat be?

Perhaps it is time to lobby using the ATLAS study against paddle in surfing in sanctuary waters and elsewhere, you never know how much impact is damaging resources, perhaps we could solicit a scientific study from NOAA to research any probability. And Surfrider members could fund it in good faith.

Claiming one precedent as a victory can affect many other users groups, we are not protected from the water grab that is taking the entire western coastline of the United States. I fear for the future of my children and their access rights to recreational pursuits, if this is a victory, I am ashamed of the weakness in America. A chronic dysfunction of our generation lies in not participating and holding our government accountable for the stewardship we entrusted in them on our behalf.

Surfrider is just another pawn of those in power who will add such groups in favor or their goals as 'partners'. I do not see any recreational partners that are equal in stature and presence. "Stakeholders have been burned at the stake."

Who will be the privileged surfers who are granted the right to towsurf at Mavericks? Since when did Surfrider and NOAA manage recreational surfing as part of their charter? This is a sad day in the State of California for surfers, state boating resources and other recreationalists. Will surfing itself be targeted next? Surfrider has good programs in effect, but Surfrider is given a grade 'F' for failure on this one folks.

What a disgrace to justice and the right to due process, it is a direct violation of our Constitutional 3rd Amendment. This is not a victory, it is a shameless water grab using environmental concerns as an excuse.

After nearly a decade of working with Surfrider Foundation's San Mateo Chapter and various other stakeholders, the National Oceanic and Atmospheric Administration is enacting new regulations designed to enhance wildlife protection in the Monterey Bay National Marine Sanctuary. The new regulations close an existing loophole that allowed unregulated usage of marine personalized watercraft (MPWC) within the Sanctuary. MPWC use will now be confined to four established zones, restoring the original intent of the law-protection of the National Marine Sanctuary. Additionally, a fifth seasonal zone was created to allow limited tow-in surfing at the world-renown Mavericks surf break, during certain times of the year when wave heights exceed 20 feet.

SURFRIDER CELEBRATES INCREASED PROTECTION FOR MONTEREY BAY SANCTUARY


New Regulations Close Loopholes and Establishes Seasonal Fifth Zone For Personal Watercraft Use


After nearly a decade of work, the Surfrider Foundation is celebrating a twofold success that balances resource protection with recreational access in the Monterey Bay National Marine Sanctuary (MBNMS).

Through a joint management plan review process in which many stakeholders participated, the Surfrider Foundation and its chapters worked with the Sanctuary officials and the National Oceanic and Atmospheric Administration (NOAA) to close a loophole in the laws governing usage of motorized personal watercraft (MPWC) in the Monterey Bay National Marine Sanctuary. The original restrictions were established in 1992 and designed to provide enhanced resource protection for marine mammal and seabird concentrations, kelp forests, river mouths, estuaries, lagoons and all near shore areas that numerous studies have shows to be highly vulnerable to disturbance and injury from personal watercraft. However changes in watercraft technology and design resulted in a definition loophole that allowed newer three- and four-seat personal watercraft models to operate outside of the four established zones within the Sanctuary. By changing the definition and closing the loophole, MPWC will be relegated back to the four established zones, restoring the original intent of the law.

Additionally, NOAA has established a seasonal fifth MPWC zone at Mavericks. NOAA chose Mavericks as the seasonal fifth zone due to the break’s close proximity to an existing offshore MPWC zone. NOAA expects to minimize MPWC impacts to the local environment by restricting their use in this new zone, which borders the existing Fitzgerald Marine Reserve. The seasonal fifth zone would be open for tow-in surfing and MPWC usages from December through February during National Weather Service-issued high surf warnings.

The inclusion of an additional seasonal fifth MPWC zone at Mavericks for tow-in surfing balances recreational access with maximum protection for Sanctuary resources. The Surfrider Foundation and its local San Mateo County Chapter recognize the value of these objectives and view the seasonal zone as a solution that holds protection of a National Marine Sanctuary in highest regard while allowing recreational use of MPWC.

“From the start, our goal has been maximal protection for the National Marine Sanctuary,” says Edmundo Larenas, Chair of the Surfrider Foundation San Mateo County Chapter. “We are pleased that NOAA’s inclusive approach with all the stakeholders in working to define the governing regulations produced a result that will restore protection to the National Marine Sanctuary.”

While the new regulations seek to protect Sanctuary resources and recreational access, the Sanctuary and stakeholders will have to work together to address issues such as safety, enforcement and environmental protection.

“The addition of a fifth zone will not be without its challenges,” Larenas cautioned. “With the seasonal fifth zone in place, it is important for all stakeholders to continue working together to safeguard the environment around the established fifth zone.”

The new regulations are expected to go in effect February 2009.

Unfortunately I'd have to ride the fence on this one. As a watercraft racer and surfer (I was a surfer first) I can agree to disagree with both sides, and to comment on the impacts of surfing on the "sanctuary" vs recreational PWC riding I'd have to side with the surfers especially tow-in surfers at Mavericks. Most all tow-in surfers and/or big wave surfers that I know are HIGHLY skilled, responsible and respect mother nature for her gifts, and UN-fortunately most rec PWC riders that I come accross could careless about the waters and/or others using the waterways. God knows I've picked more trash out of the five "small" public lakes I ride on than the (what I would consider) five busiest surfing beaches on the east coast i.e. New Symrna inlet, Sebastian inlet, Coccoa's pier (when a hurricane is in town) to second light, and Bethune. This is just my own opinion on the subject, I'd have to think if anyone out in the water has to pee they're going to, regardless of what they're sitting on be it a board or a seat.

Your view is important and valid. But if we take it to measureable levels, this isn't about surfing. It's about personal watercraft access and the privilge of boating recreationally, regardless of what you choose to do.

What gives a surfer more rights than a PWC, or a stand up paddleboard, or a kiteboard? Only biased viewpoints based off of either a positive or negative experience. Should I lose 5,000 nautical miles of boating access becuase surfers don't like PWC's? I say not, it doesn't make it right. Education, Safety and Enforcement can manage those problems.

Should all PWC users be banned because surfers don't like PWC?

Take that question to every coastal access across the US or Australia, or Hawaii. It's not the PWC that is the issue, its the behavior of those who break boating laws that are applicable. Just like you say and I agree with you.

I agree completely about the recreational PWC operators, not all are bad, such as towsurfers or surfers etal, but certainly this community has EARNED the stigma that is associated with the boats we use. This/Our community has brought their own house of cards down against themselves in some respects, not caring about the negative impact they create enough to make an observation and take more responsibility.

The point is if one recreational activity is going to be selected as bad, all have bad elements, including surfing, of which I also own 12 boards, including 4 tow boards... It's an analogy and it is fitting. Why should one activity be presented as elitist, and certainly I have seen my measure of agressive and selfish tendencies in surfers, because it is a human condition not selective to the activity itself.

Unfortunately in this case, it was surfers themselves that towsurf who brought the Sanctuary access to the pinnacle and lost it for people like myself and others who do care and do boat responsibly and who do try to make a concerted effort for education and responsible use.

When push came to shove, the surfing community has fed upon itself and now that the PWC issue is closed in this sanctuary, they'll all fold back into paddle surfing again, a real nice BURN huh? Take what you can get from towsurfing, and surfing, and sell out, but not take a stand.

So I guess it's the same problem either way you look at it.

As the Mavericks people meeting today, Here's an Idea.... let them have their competition this year WITHOUT any Ski's. No tow ins AND no Ski rescue. Just my two cents.

( P.S. Surfrider has never represented my interests in any way shape or form. Not as a swimmer, surfer, boater or PWC rider. )

Ah...LOL Posting the home.....very clever. oh man...

Moss Beach, yeah that is not allowed off the lgihthouse area. There is one zone outside of the Pillar Point Harbor, but the buoys are not marked well. It is not in any surf area and its a small zone, you can basically ride in circles in that desginated area. Check in with the Pillar Point Harbor Department and they can show you on the map.

They have scripted my business so I cannot teach public safety agencies in sanctuary waters with our training programs. They have also scripted this so ONLY existing personnel can train, NOBODY from outlying counties, cities or states can come and train for mutual aid. You have to read the language correctly becuase it sounds ok, but it is a block essentially. A prejudice against PWC use even on behalf of saving lives for our citizens, and it waters down the safety of professionals who cannot train properly or effectively to save thier own life!

Plus there has never been a tow in surfing compeititon at Mavericks. I will be astounded the day that happens! As if that token carrot will solve anything.
